Do you need a license to start a staffing agency in the US?
Which US states require a staffing or employment agency licence, and the registrations every agency needs regardless of state.
The short answer
There is no federal staffing licence in the US, but several states and cities require an employment agency licence or bond, and healthcare staffing is separately regulated in many states. Every agency, everywhere, needs an entity, an EIN, state unemployment insurance registration and workers' compensation cover.
Requirements are set at state level and sometimes at city level, so the answer depends on where the worker is placed, not where you are based. Place a nurse in one state and a warehouse operative in another and you are inside two regulatory regimes with two unemployment insurance registrations.
Healthcare is the strictest category. Nurse staffing and home care agencies face licensing, registration or certification in a large number of states, often with bonding, staffing-ratio, background-check and record-keeping conditions attached. Budget for it before you take the first clinical order.
Whatever the state, the universal list is short and non-negotiable: a registered entity, an EIN, state unemployment insurance in each placement state, workers' compensation, and general and professional liability cover at limits your clients will accept in a certificate of insurance.
