How do you register a staffing agency in the US?

Registration is the easy half of opening a staffing agency, but the order matters. Every downstream step — bank account, payroll provider, insurance binder, client onboarding — asks for the entity and EIN, so a delay at the front pushes everything back by the same number of weeks.
The step founders underestimate is state payroll registration. Staffing is one of the few small businesses that routinely employs people in states it has no office in, and each of those states expects a withholding account and an unemployment insurance account before the first paycheque. Registration can take days in one state and weeks in another, which is why the placement state should be confirmed at the order stage rather than the offer stage.
Workers' compensation is bound by job classification code, and the class you declare determines the premium. Declaring clerical rates and then placing warehouse operatives produces an audit adjustment that can be larger than a month of gross profit, so describe the actual work you intend to place.
Client onboarding then runs on paper you should have ready: terms of business, a certificate of insurance matching the limits in their master services agreement, W-9, and often a vendor security questionnaire. Enterprise clients will not wait while you arrange these, and the certificate in particular can take a week.
Finally, choose the payroll stack before you need it. A staffing payroll runs weekly, spans multiple states, carries per-assignment pay rates and must reconcile back to approved timesheets. General small-business payroll tools handle that badly, and switching mid-growth is painful.

An LLC taxed as an S-corp or a C-corp are both common. Form in the state where you will operate; a Delaware entity adds a foreign qualification in your home state without adding protection for a small agency.
